Ownership of Copyright and Grant of License

Maison Art Photo (hereinafter the “Photographer”) retains full intellectual property rights and exclusive copyright over all photographic images, video footage, and visual content (hereinafter the “Media”) produced for its clients and related to properties.
The Photographer hereby grants the client (hereinafter the “Licensee”) a non-exclusive and limited use license for the said Media, subject to the conditions set forth below.

Conditions of Authorized Photo Use
The Licensee is authorized to use the Media specifically for the promotion and marketing of the property concerned on the following platforms and for the following uses:

Centris.ca
Realtor.ca
The website of the real estate agency of which the Licensee is a member.
The Licensee’s social media (Facebook, Instagram, LinkedIn, etc.), exclusively for posts related to the promotion of this specific property.
Printed brochures, flyers, and other physical marketing materials dedicated to the sale of that same property.

This license is valid exclusively for the duration of the active listing of this specific property on the market. Once the property is sold, withdrawn from the market, or the listing expires, the Licensee’s use of these Media must cease.

Restrictions and Important Clauses
The Licensee is formally prohibited from:

Selling, assigning, transferring, sublicensing, or distributing the Media to third parties, including, but not limited to, potential buyers, other brokers, or third parties not involved in the initial sale of the property.

Modifying, altering, or manipulating the Media in any way without the prior written consent of the Photographer (this includes excessive cropping, applying filters, or any substantial modification).

Using the Media for any other property, for the Licensee’s general promotional purposes not directly related to the sale of this specific property, or for commercial purposes other than those expressly authorized above.

Claiming copyright ownership of the Media.

In the event of non-compliance with these conditions, the Photographer reserves the right to immediately revoke this license and initiate any appropriate legal action for copyright infringement.
